UN Security Council

This article offers an assessment of the structure and functioning of the Security Council of the United Nations System, as established by the Charter of the Organization, from the perspective of democracy. To this end, with the application of historical-legal methods and legal-doctrinal analysis, historical and theoretical considerations were systematized and the theory of democracy was analyzed. The results obtained show the absence of democracy in articles 23, corresponding to the composition, and 46, regarding the members of the Military Staff Committee that advises and assists it, among others.

The international community, on the basis of the marked differences between States as regards the functions performed by some of them in its organs – such as the establishment of the right of veto by the five major powers that make up the Security Council – is calling for a democratic UN.

From the doctrinal point of view and in view of the above, researchers from various regions, such as Del Prado (2000); Rey (2014); Sainz (2016); Fiumara (2017); and Romero (2017), consider that such democratization should be immediately extended to the Security Council.
