On the other hand, in tax matters, Article 134(7) of the Constitution provides that the Budget Law may not create taxes, although it may modify them when a substantive tax law so provides.
Matters outside these provisions are matters outside the scope of the General State Budget Law. Thus, the content of the Law is constitutionally limited – unlike what happens with other Laws, the content of which is, in principle, unlimited – within the State’s sphere of competence and with the exclusions inherent to matters reserved to an Organic Law.
The foregoing does not prevent the duty to comply with the commitment to budgetary stability enshrined in the Constitution, moving towards a scenario of fiscal consolidation and financial sustainability in the medium term which will enable the requirements of budgetary balance derived from the European Fiscal Pact to be met, as soon as the circumstances which gave rise to this extraordinary situation so permit.

However, Murphy said during the briefing that his administration is still trying to figure out exactly how much the state will receive from the federal aid package and exactly what they will be able to use those funds for.
“The world has changed drastically since my state budget speech that I gave (in February), so we will have to take this circumstance into account, there’s no other way around it,” Murphy said during the briefing. “How the current circumstances affect this, it’s too early to tell.”

What is the tax year?
The confinement and limitations to mobility have raised some doubts about the IRPF tax treatment of several issues that must be taken into account for the preparation of the income tax return for the 2020 tax year.
This same criterion is applicable for the 6-month period in the case of taxpayers over 65 who allocate the total amount of the transfer of assets to the constitution of the life annuity, i.e., this six-month period is understood to be paralyzed between March 14 and May 30.
In line with this, the DGT considers that the amounts paid to the employees by the companies to cover this type of expenses, during the confinement or those employees in teleworking periods, will be subject to IRPF taxation and consequently, subject to withholding by the companies.
A different matter is the delivery to the employees of the necessary tools for teleworking. Thus the delivery of laptops or cell phones for the exclusive use of professional purposes does not have, in our opinion, the consideration of remuneration in kind, and therefore the company will not have to make any income on account. However, we believe it is appropriate to go a little deeper into this issue.
