Cases of personal data breaches

A data security breach occurs when data for which you are responsible suffers a security incident that results in a breach of confidentiality, availability or integrity of the data. If this occurs, and the breach is likely to put an individual’s rights and freedoms at risk, you must notify the supervisory authority without delay and no later than 72 hours after you become aware of it. If you are a processor, you must notify each data security breach to the controller.

If the data security breach poses a high risk to the data subjects, the data subjects must also be informed (unless effective technical and organizational protection measures or other measures have been implemented to ensure that the risk is no longer likely to materialize).

Data of employees of a textile company have been disclosed. The data includes personal addresses, family composition, monthly salary and medical expenses of each employee. In this case, the textile company must inform the supervisory authority of the security breach. Since they include sensitive personal data, such as health data, the company must also notify the employees.
