The ambivalent reality in relation to armed conflicts and sporadic acts of violence due to the typology of the actors involved, the gradual intensity of the acts of violence such as internal tensions and internal disturbances of combat between regular armed forces and organized armed groups, or between them, make the material application of the norms of IHL and IHRL difficult.

This article, through a set of legal and factual premises that imply a holistic study, and not an isolated one of a factual situation, will argue that the thresholds of intensity of contemporary armed conflicts are fundamental objective criteria for the material application of IHL and IHRL norms for new actors in the conflict, and for the lethal use of force.

Although it is true that the features of the theoretical exercise that we proposed would be established from the comparative praxis itself, we were shelling out some organizing axes. In the first place, the need to establish a dialogue between authors, a communication of notions belonging to different philosophical traditions, was clearly established. But this dialogue implied going beyond the descriptive dimension, a necessary but not sufficient layer according to Enrique Marí (1990) who, in his work Elementos de epistemología comparada (Elements of Comparative Epistemology), inaugurates this intellectual exercise. The exercise was not reduced to the inventory of differences, of encounters or disagreements, but implied a critical and reflective communication of categories belonging to different horizons. As Silvia Rivera states in her text in which she puts in dialogue Wittgenstein’s “forms of life” with the category of “biopolitics” -and which constitutes an exercise of comparative traditions-: “It is a matter of discussing the theses from a pendular movement that tensions and fricts them, showing edges hitherto invisibilized” (Rivera, 2019:13).
