One is the energy certificate, which the Notary will ask you to sell your apartment or house, and the importance of managing the certificate of occupancy, which certifies that the space is enabled for residential use.

Also known as Energy Efficiency Certificate (CEE), it has the purpose of certifying the energy performance of the building or house that you want to sell or rent. In addition, this document offers the user improvement options for energy efficiency. This certificate is regulated by the regulations provided in the royal decree 235/2013, which approves its use and its mandatory status for any building or house.

This document accredits that it is a space that can be used as a dwelling. Residential buildings have it and it is not a document that you need in the purchase and sale of a home since it was given when approving the construction project. You only need to check if it is expired or still in force. Duplicates can be obtained at the headquarters of the relevant territorial administration.

How is the energy certificate renewed?

For the renewal of the energy certificate, the owner must contact a competent technician to make the document again or at least update the existing one. Failure to do so would be in breach of the obligation to renew or update the energy certificate.

Energy performance certificate obligation

The energy efficiency certificate, in order to be a complete document, must include the minimum content indicated in Article 6 of RD 235/2013, must be signed by a competent technician and be made with one of the documents recognized by the Ministry of Energy registered in the general register: CE3, CE3X, Cerma and Lider-Calener.

In newly constructed buildings, the energy efficiency certification is carried out in two phases: a project energy efficiency certificate and an energy efficiency certificate for the finished building. Newly constructed buildings are understood to be those whose building permit application is after November 1, 2007.

The promoter will be informed during the registration process of the energy performance certificate of the project, if it must be submitted to an external control, and once registered, it will be incorporated to the execution project. Subsequently, once the building has been constructed, the energy efficiency certificate of the finished building will be issued, which will also be registered in the register of energy certification of buildings and will be included in the building’s book.

Therefore, registration may take more or less time. It all depends on where the property is located.

It is usual to obtain the energy certificate and proof of registration within one to five days. However, this may vary if the time of completion coincides with a weekend or a holiday period, not because the professional has not done his work, as many people tend to visit properties on weekends, but because the official registers are closed on those days.

Once the energy certificate has been registered, the body under the Ministry of Industry will issue an energy label, which is the one that has to be shown in the advertisement together with the energy rating of the property.
